Boehner’s infamous suit against Obama is to be expanded, or at least that is what he is considering. The key issue here is the role of executive orders and their constitutionality; remember that all legislative authority is vested in the US Congress. This is such good evidence for the increasing polarisation of US politics and of the separation of powers battles that exist within US politics.
While Boehner is struggling to find a law firm to take up his case, it would be an important ruling to watch, not only for the Congress v President aspect, but because with the Republicans now holding both houses, it is possible we may see the much wider use of the executive order power in the final two years of Obama’s presidency. If he were to lose this case, that would make this power much less ‘imperial’.
