Schuette v BAMN – The Supreme Court and Affirmative Action, again!

The Supreme Court this week have passed another important ruling. The Court voted to uphold ‘a constitutional amendment in Michigan voters approved in 2006, banning preferential treatment based on race, gender, ethnicity or national origin.’

The decision was 6-2 (a useful example of a Justice recusing herself; Kagan here, for reasons yet unknown) showing a move on the court against Affirmative Action increasingly. Unsurprisingly, Sotomayor was a dissenting Justice which also gives useful evidence for the importance of recent appointments.
